Buying your first home is an exciting milestone, but it can also feel overwhelming. In a vibrant market like Regina, being prepared is key to a smooth and successful journey. This week, we're kicking off our series by tackling two of the most fundamental questions every first-time homebuyer has: how to navigate the process from start to finish, and when to bring in the legal experts.

From House Hunting to Moving In: A Step-by-Step Guide

The path to homeownership can be broken down into several key stages. While every purchase is unique, here's a general roadmap of what you can expect:

  1. Financial Preparation: Before you even start browsing listings, it's crucial to get your finances in order. This means checking your credit score, saving for a down payment, and getting pre-approved for a mortgage. A pre-approval will give you a clear idea of your budget and show sellers that you're a serious buyer.   2. Finding the Right Real Estate Agent: A good real estate agent is your most valuable asset. They'll not only help you find properties that meet your criteria but also guide you through the entire process, from making an offer to closing the deal. Look for an agent who specializes in the Regina market and has experience working with first-time buyers.
  3. The Search Begins: This is the fun part! Your agent will set you up with listings that match your needs and budget. Be prepared to visit several properties before you find "the one." Take notes, ask questions, and trust your instincts.
  4. Making an Offer: Once you've found your dream home, it's time to make an offer. Your agent will help you determine a fair price and draft a legally binding offer to purchase. This document will include the purchase price, your desired possession date, and any conditions that need to be met before the sale is final (such as a satisfactory home inspection or financing approval).
  5. Negotiation and Acceptance: The seller may accept your offer, reject it, or make a counter-offer. This is where your agent's negotiation skills will come in handy. Once you and the seller have agreed on the terms, you'll have a legally binding contract.

When Do I need a Real Estate Lawyer?

While your real estate agent is your guide through the home buying process, your lawyer is your legal advocate. They, along with your real estate agent, will ensure that your rights are protected and that the transaction is completed correctly. So, when should you bring them in?

Ideally, you should have a lawyer in mind before you even start making offers. Don't have a lawyer? Your real estate agent can be a great source for a referral. They'll be able to recommend a lawyer who specializes in real estate law and has a good reputation in the Regina community.

Once the sale is finalized, your real estate agent will send all the necessary purchase documents to your lawyer. 

Your lawyer will then:

  • Review the purchase contract and advise you of any potential issues.
  • Conduct a title search to ensure that the seller has the legal right to sell the property and that there are no liens or other encumbrances on the title.
  • Prepare the closing documents, including the statement of adjustments, which outlines all the costs associated with the purchase.
  • Handle the transfer of funds on the closing date.
  • Register the new title in your name.

Once the lawyers (both for seller and buyer) complete their paperwork, the transaction is nearly done!

The sellers lawyer will provide "release of keys notification" the day prior or morning of possession date. Once that occurs your agent will meet you at the home, hand over the keys and complete a walk through to make sure the home has been left in the expected condition and also to make sure things that were asked for were left behind (appliances, tv mounts, etc) to name a few.
